You hired some new employees. You had them fill out Form W-4 and the I-9. They read the employee handbook and go through training. That’s it, you’re done, right?

Did you know that you now also have to report your new hires to your state within a short amount of time? This is called the New Hire Reporting. So, what is it?

 

 

 

What is new-hire reporting?

The Personal Responsibility and Work Opportunity Act of 1996 (PRWORA) requires you to report all new hires to your state. This Act also applies to any rehired employees. Federal law does not require you to report independent contractors. However, some states may require you to report them.

New hire reporting applies to all public, privet, non-for-profit, government employers. No business is exempt for reporting.

What does the state do with all this information? The state will use this information to enforce laws and benefits.

States can use this information for the following:

  • Accelerate the child support income withholding order process
  • Collect child support from parents who frequently change jobs
  • Locate non-custodial parents
  • Stop fraudulent recipients of unemployment insurance.
  • Prevent and stop unlawful welfare assistance
  • Help stop false workers’ compensation claims.

 

States also submit the new hire information to the National Directory of New Hires. That way all states have access to other state databases. This allows access for other states to track down people who may have moved. You must report all new hires and re-hires to your state agency that handles the state’s new hire reporting program.

What information do I need?

Requirements vary by states, however employers are required to submit the following information with respect to each new hire. These are sometimes referred to as the “federal data elements” required for new hire reporting.

  • Employer’s name
  • Employer’s address
  • Employer’s federal EIN number
  • Newly hired employee’s full name
  • Employees’ address
  • Employee’s social security number
  • Date that services for remuneration were first performed by the employee

 

When do you need to submit?

Federal Law says you must report all new hires within new-hire reports must be submitted within 20 days of the date of hire If sent by mail. And reports submitted electronically or magnetically must be submitted twice a month, not fewer than 12 days nor more than 16 days apart.

States may mandate a shorter amount of time for the reporting process. Make sure you follow your state law. You must report new hires even if they only work one day. You must report new hires even if they are terminated prior to completing the new hire reporting.

 

How to submit? - Format and methods

Information required by federal law may be submitted using Form W-4, Employer's Withholding Certificate, or, at the employer's option, an equivalent form. Many states have developed their own new-hire reporting forms.

Employers may submit new-hire information via first class mail, by fax, electronically, or using magnetic media. Employers should check with their individual state to determine the methods of data transmission available in that state.

 

What if I have employees working in more than one state?

Employers with employees working in more than one state may choose to satisfy their new-hire reporting requirements by reporting new hires in every state in which they do business to just one state. To exercise this "multistate option," the employer must notify in writing the U.S. Department of Health and Human Services of the state it has chosen. It’s optional but “A Multistate Employer Notification Form for New Hire Reporting” may be used to make the notification.

 

What happens if I don’t comply?

If you have never reported a new hire, report all employees hired within the last 180 days and from then on, every 20 days of their hire.

There are penalties for not reporting new hires. Each state can vary. However, federal law says your state can charge you up to $25 per employee. Also, if you and employees create a conspiracy to avoid reporting, you can and will be fined up to $500 per employee. Each state can also impose a non-monetary civil penalty for non-compliance.

Make sure to check with your state for all reporting information, including how quickly you need to report all new hires.
